Participant Waiver

The Golf Social ("the Company") provides golf simulator activities at events. I am choosing to participate in golf simulator activities, including swinging golf clubs, hitting golf balls into an impact screen, putting, and being in or around the simulator and surrounding event area (together, "the Activity").

I understand the Activity carries inherent risks that cannot be fully eliminated, including but not limited to:

• being struck by a swinging club, a golf ball, or a ball that bounces back off the screen, walls, floor or equipment;
• muscle strains, sprains, back injuries and other injuries from swinging or twisting;
• slips, trips and falls on turf, steps, wet or uneven ground;
• eye injuries, cuts, bruises, broken bones, concussion and, in rare cases, serious injury or death;
• equipment failure, low lighting, and the actions of other participants or spectators.

I voluntarily choose to participate and assume all of these risks, known and unknown, for myself and any minor I sign for.

To the fullest extent permitted by law, I release, waive, and promise not to sue The Golf Social, its owners, members, employees, contractors, volunteers, and the hosts or property owners of any event where the simulator is set up (the "Released Parties") for any injury, illness, death, or loss or damage to property arising out of or related to my participation in the Activity, including claims caused by the ordinary negligence of the Released Parties. This release does not apply to gross negligence or intentional misconduct.

I agree to defend, indemnify and hold harmless the Released Parties from any claims, costs or attorney fees brought by me, any minor I sign for, or anyone injured because of my conduct or failure to follow the rules.

• Only one golfer in the hitting area at a time. Everyone else stays behind the marked safety line.
• Look around before every swing and never swing toward people, walls or the projector.
• Wear closed-toe shoes and use caution on steps, turf and uneven ground.
• I will not play while impaired by alcohol or drugs, and staff may stop anyone from playing at any time.
• Children must be supervised by a parent or guardian at all times.
• I will report any damaged equipment or unsafe condition to staff right away.

I am responsible for damage to equipment I cause through misuse or ignoring these rules.

I confirm that I (and any minor I sign for) am physically able to participate and have no medical condition that makes swinging a golf club unsafe. If I or the minor am injured, I authorize the Company to call for emergency medical care, and I accept responsibility for its cost.

This agreement is governed by the laws of the State of Utah. If any part is found unenforceable, the rest stays in full effect. This agreement covers today's event and any future Golf Social sessions I attend. I agree that my electronic signature below has the same legal effect as a handwritten signature.
